SALES TAX: You will be required to pay sales tax if you pick up the product at our location. If you have a resale number you must have a tax form filled out signed by the owner of the company and meet the state of Utah and Salsbury Enterprises distributor requirements. If you are shipping in the state of Utah you will be required to pay sales tax unless you meet the distributor requirements. If you are shipping out of the state of Utah you will not be required to pay sales tax.

PRICE CHANGES: Sellers prices are subject to change. Although we are doing everything we can to keep prices down, our suppliers raise their prices constantly and we have to adjust our prices as well. The current price list is available on our web site, however because of the constantly changing market conditions we reserve the right to make changes to the price list at any time. All prices are subject to change. We can’t guarantee the prices. When your order ships it will be adjusted.

BACK-ORDERS: We do not place items on back order. If you order something and we do not currently have it in stock, we will not place it on back order or hold up the rest of your order because we have no control over when those items will be in stock again. Please re-order at a later date.

WARRANTIES: Seller makes no warranty or representation of any kind, expressed or implied, (including warranty of merchantability or of fitness) with respect to goods sold hereunder.

Any affirmation of fact or promise made by the Seller to the Buyer which relates to the goods sold there under shall not be regarded as part of the basis of the bargain and shall not be deemed to create an express warranty that such goods shall conform to the affirmation or promise. Any description of the goods sold there under shall not be regarded to create an express warranty that such goods shall conform to the sample or model.

Final determination of the suitability of the material for the use contemplated by Buyer is the sole responsibility of Buyer, and Seller shall in no way be responsible for the suitability of the material for any particular end use.

Seller makes every effort to provide products that are of the highest quality and finest ingredients available, and when purchased are free of manufacturers defects. If a product is found to be defective, then the customer may return the product for a replacement or request a full refund subject to the Limitations and Remedies and Returns and Cancellation Policies.

LIMITATIONS AND REMEDIES: within ten (10) days after receipt by Buyer of the goods and before any part of the material has been changed from its original condition, Buyer shall inform Seller in writing if the material is found defective or short in any respect. Failure to so inform the Seller shall establish conclusively that the goods are satisfactory.

If any of Seller’s products are claimed to be defective by Buyer and Buyer has so informed Seller as above provided, a sufficient quantity of such gods shall, within fifteen (15) days after the first delivery thereof, be returned to Seller with transportation charges prepaid, to enable seller to test and analyze the same and if such tests and analyses show that such merchandise is defective, the Seller will replace, at its facility, such of its products as shall have been so proved defective.

All goods and materials manufactured by Seller are carefully tested and inspected before leaving point of manufacture, but as it is impossible to always detect imperfections our only liability shall be to replace such goods manufactured, but as it is impossible to always detect imperfections our only liability to replace such goods as prove defective, as above set forth; under no circumstances shall Seller be responsible for any damages beyond the price of replacement of the goods and Buyer hereby waives any and all other claims for damages, including but not limited to consequential damages, incidental damages, damages for expenses, labor or materials otherwise claims for latent defects, loss of goodwill or anticipated profits.

Seller shall not be responsible for delay of any shipment, caused by fire, strikes, labor disputes, railroad car supply, embargoes, or to the causes beyond its control.

RETURNS POLICY: Any items that are returned must be pre-approved by Salsbury Enterprises. We do not accept merchandise for return after 10 days. There is a 20% restocking fee. You must have a RMA # in order to have items returned or they will be sent back. All returned merchandise, must be accompanied by a sales receipt. NO MATERIALS ARE TO BE RETURNED WITHOUT AUTHORIZATION: If a customer, having purchased a product from Seller, finds a product to be defective in any way, then upon receipt of the defective product, subject to Limitations and Remedies Policies, Seller will either replace the product with a similar item. Copies or facsimiles of invoices or receipts will not be accepted.

CANCELLATION POLICY: A customer may cancel an order anytime prior to shipment, without cost, as long as their credit card or check has not been processed.

If a customer’s credit card or check has been processed prior to the product ordered having been shipped, there will be a .05 processing fee of the total order.

If a customer’s credit card has been processed, and the products ordered shipped, and the customer then desires to cancel the order, then the customer will be responsible for the cost of return shipping plus  .20 percent of the total order restocking fee. The products must be returned in their original unopened condition.  However, the cost of the products, less shipping and restocking, may be refunded to the customer as long as the return requested is accompanied with an original invoice or receipt and subject to the Limitations and Remedies Policies. Facsimiles or copies of invoices or receipts will not be accepted.

DELIQUENT PAYMENT AND ATTORNEY’S FEES: Buyer agrees to pay a late payment charge of one and one half percent (1 ½%) per month, compounded monthly, if the goods are not paid for within twenty-five day of the date of the invoice. If the account is referred to an attorney for collection after delinquency, Buyer agrees to pay all court costs and attorney’s fees incurred by Seller in collecting all amounts due to Seller, whether or not suit is commenced.

PRODUCT PRICING: Because of difficult economic times, prices shown on Our Little On Line Store, may change without notice. When an order had been placed, and prices change, current prices will be charged.

If a particular product is not available, then Salsbury Enterprises will replace that product with a similar product of the same or greater value without an increase to the customers order.

SHIPPING: Due to the economic difficulties and the heavy demand large orders are being shipped within 4 to 6 weeks. All products will be shipped using the carrier best suited for the delivery. The least expensive means and carriers will be used.

For small orders the USPS will be used and USPS shipping rates and zones will be utilized.

For printed materials, USPS media mail rates will be used.

Shipping cost is determined by zip code, the weight of each individual box (our products are heavy), the total weight of all boxes being shipped together, the dimensions of the boxes, and whether the address is a residential or business address. Orders over 700 pounds total weight may be able to save money by shipping through a freight company. AT the time you place an order an estimated shipping price will be given which may differ from the actual shipping cost once your order is packaged and weighed for shipping. We will always do our best to find the lowest shipping costs for you. Note that shipping will be added to all orders unless other wise noted. If you need a freight quote it will not b available until your order is ready to be shipped. Shipping rates are running about $.50 to $1.00 per pound.

FREIGHT POLICY: For large orders, certified freight carriers will be used. Freight charges will be based on weight, container size and shape and distance to be shipped. Customers placing large orders will be notified of shipping charges prior to shipping, by email or telephone.

DAMAGED ORDERS: Freight damaged claims need to be initiated from your end. Be sure to inspect your delivery for damage and note any damage on receipt. Make sure you claim is in writing and there is a signature on the form.

TURN AROUND TIME ON ORDERS: sellers turn around time for most of our products is averaging 7-14 working days. However, occasionally this maybe longer, depending on current demand of specific products.

MODIFICATIONS: The terms and conditions hereof cannot be varied, altered, modified or abandoned, in whole or in part, except by an agreement in writing signed by the parties hereto. No employee of the Seller has authority to waive, verbally or otherwise, any of the terms or conditions hereof except by a writing endorsed on the face thereof and signed by an executive officer of Seller.
